To address the widespread and growing concern of contaminated food causing serious injury and death to individuals throughout the u. s., congress passes a law which provides that anyone intentionally distributing contaminated food is subject to criminal prosecution, civil fines, or both. congress has provided a safe-harbor provision that any company with a corporate food safety compliance policy approved by the fda may avoid criminal prosecution, but not civil fines. this policy requires a company to report any contamination to the fda so it can be proactive in monitoring any health risks.
