Art collector commissioned an artist to create a sculpture. The artist wanted a substantial amount of money. The collector became concerned about potential dissatisfaction with the work once it was completed. The parties agreed that payment is due only if the collector is satisfied with the work, relying on the collector’s taste and judgment. The artist never imagined that a collector could reject his work; so, he allowed the condition to be in the contract. At the completion of the sculpture, the collector claimed that she did not care for the artwork and therefore refused to pay. Can the artist force payment? Would it help if the artist proved that the collector approved the sculpture, but has temporarily run short on funds?
