John Smith, a singer from Dallas, sued Music Now, a California magazine and corporation for defamation. Smith alleged that Music Now falsely reported that another much better singer had performed the vocals on his songs. During the discovery process, Music Now produced evidence that it had never published anything about Smith including any allegedly defamatory statements about whether Smith had performed the vocals. As such, the Music Now believed that Smith did not have any evidence to prove his cause of action for defamation.
