In this case, the Prince does not sentence Romeo to death for Tybalt's murder because Tybalt killed Mercutio so both sides of the feud have lost someone. However, the Prince cannot let Romeo go without a consequence so he banished him rather than take his life. Romeo feels that banishment is worse than death, but Friar Laurence is trying to have him see it differently.
