However, the ruling went against the 14th in that the Japanese were not treated equally compared to other races and were targeted just because they posed a "threat" to the war and were racially profiled based on what the Japanese had done during Pearl Harbor. For the 1st Amendment, they violated the Japanese freedom of everything in that they were basically imprisoned because of being a danger. Korematsu used the 5th Amendment because of them suspending Habeas Corpus and because they were being held without cause. Also they could use the 8th amendment for cruel and unusual punishments.
