mcsween, along with his partner john tunstall opened a store and bank within the range of "the house" and wanted to try and be the top dominate power within three years opening. "the house" didn't like this and entered into a civil suit with them.

the judge took in favor of "the house" and confiscated their store and took claim of tunstall's livestock. tunstall  went to oppose the taking of his land. when he went to challenge the "posse" that was formed by the local sherriff, and he was met with a fight and ultimately killed. mcsween was a former lawyer and tried to take the route of the law. he wrote letters to get warrants out for tunstall's killers. eventually, the violence escalated and this is how "billy the kid" began.
