Option 1. While we should always be skeptical of laws that discriminate
against any race, sometimes protecting the public good overrules the rights of
a few. We have entrusted our military to make tough decisions for us at this
time. They found that a number of Japanese American citizens showed
disloyalty to the U. S., and at this time of war it seemed necessary to uphold
the military's decision.
Option 2. The military's order of exclusion is controversial, so we must decide
if the benefit to the public outweighs the drawbacks of the decision. Japanese
American citizens like Fred Korematsu have been spying on behalf of Japan
and threaten our nation's security. Our military is the only force that can truly
protect us at this time of war, and it should be allowed to do whatever is
necessary, including infringing upon the rights of those connected with the
enemy.
Which option provides an objective, accurate summary of Justice Black's
opinion, and why?
