The case of Obergefell v. Hodges is a Supreme Court case in which the issue of same-sex marriages was settled regarding the states' mandate to issue marriage licenses to same-sex couples. The case was first heard in 2015 and involved 4 states, Michigan, Ohio, Kentucky, and Tennessee who had previously banned the issuance of same-sex marriage licenses.

At stake were a total of 6 cases (3 from Ohio) where the states had refused to issue marriage licenses because the couples were of the same biological sex. Thirty-six other states already issued same-sex marriage licenses. Kentucky, Ohio, Michigan and Tennessee were holding out. The district courts for these states had affirmed their cases, but the Sixth Circuit Court of Appeals had reversed their decisions. The states then appealed to the Supreme Court of the United States.

There were two main issues the Supreme Court would consider: 1) Does the 14th Amendment require a state to license a marriage between two people of the same sex, and 2) does the 14th Amendment require a state to recognize a marriage between two people of the same sex if the marriage was lawfully licensed out of state? The majority opinion of the Supreme Court was that same-sex marriage bans are a violation of the 14th Amendment. They stressed that the Constitution promises liberty for all and does not offer any exceptions.
