The state of New York had been slow to accept the constitution of the United States. It is the 11th state out of 13 to ratify it on July 26, 1788, just 8 months after the first ratification by the state of Delaware on December 7, 1787. The anti-federalists were numerous in New York and had a lot of influence during the debates. The vote for the constitution was still not unanimous since 12 representatives out of 30 voted against it.

The reason that pushed the majority of the New York state representative to vote was the agreement of Congress to add a human rights statement to the existing text. In a letter written by John Jay, they invited other states to accept the 25 bills where they present the fundamental rights that should be recognized by the constitution. Their main ally in this battle was James Madison of Virginia, the future president of the United States, who helped to draft a declaration of human rights that was accepted by all the other states in December 1791.
