This is a huge flaw since the criminal could be hiding something , and if he does, (under oath) and manages to get away with it, they are just exploiting the system its self. very rare on the other hand though.

4.it is mostly argument based and not evidence prone.

5. The whole system its self is a tedious procedure, lack of evidence, and unclear testimonies lead to serious mistake in the court verdict.
