CA voters pass a referendum (ballot initiative) authorizing the legislature to provide tuition grants to all students in the UC or CSU system to help offset rising tuition costs. The initiative does this by raising taxes on companies located in California. Leading corporations in the state challenge this as a 5th amendment violation of “due process” rights. What approach to this court challenge from those companies should judges take - activism or restraint?
