This is the third time this week that John’s manager has pulled him into the office for a “conversation”. This time, however, John’s manager has dismissed him from his position as a cashier and has asked him to leave immediately. John is outraged and can’t understand why he is being let go. Customers love him! However, his manager points out the following – once this week his register was short by $4.35 and he was late by 12 minutes this week as well. For both of these offenses John was written up and the infractions were placed in his employee record. Today, however, John was seen on camera eating French fries from the Fry Bin during his shift. He did not pay for them and it was not an authorized break time. John doesn’t see the problem with this behavior – he was hungry and there were not any customers at the counter. Based on unemployment benefits eligibility criteria, does John have a right to file a claim? Please provide details to support your response. What could John have done to avoid being fired? Describe a time that this happened to you or someone you know.
