#1: The accused entered an abandoned house through an open door for the purpose of taking property from the house. The charge against them was break and enter. Defence attorneys entered a plea of guilty to attempted theft instead, arguing that there was no “breaking” involved. Should the accused’s plea be accepted? What principle of law would apply to this case? Explain briefly the reasons for your decision.
