Gerald, the supervising attorney, asks his paralegal, Nancy, to file a client's negligence complaint with the local county court no later than February 1. Nancy inadvertently forgets this deadline. On February 5, she realizes that the complaint has not been filed. Unfortunately, the statute of limitations on the client's lawsuit can never be brought as a result of Nancy's failure to file the complaint by the requisite date. Can Nancy be disciplined by the state's bar association for her actions (or omissions)? Can she suffer adverse employment consequences for her conduct? Can she be sued for malpractice by the client? Can Gerald be disciplined by the state's bar association for Nancy's action? Can he, or his firm, be sued for malpractice because of Nancy's actions?
