Megan, a new server at the Lakefront Hotel’s premier restaurant, reported to work 10 minutes early. She was excited about her new job and wanted to make a good impression. Her shift started off well. One of her guests ordered something she had not tried yet. When the order came up, Megan dipped her finger into the sauce at the edge of the plate for a taste test. As the shift progressed, Megan’s station got busier. When the hostess came to ask when one of Megan’s tables could be cleared, she decided to do it herself. She took the dirty dishes to a bus station and then wiped the table with a serving cloth she kept in her apron.

The busser, John, finished another task and came to help her set the table. While he put out fresh silverware and linens, Megan dipped the water glasses with ice by scooping the glasses into the ice bin at the bus station. There was only one slice of bread and one pat of butter missing from the last table’s breadbasket, so Megan added a new slice and re-used the rest.

Megan saw the catering team rushing to get their order together, she decided she had a minute to help. She saw a couple of pans of hot meatballs, and a pan of Caesar Salad it looked like they were about to forget, she quickly stacked the pans into a cardboard box that was on the ground and chased someone to the van to load it.

Megan soon had more guests at her tables. While taking their orders, Megan reached up to her neck to scratch a sore that had been bothering her. Then she went to the kitchen to turn in the order and pushed out the ‘Dessert Cart’ to try and get another table to pick some fresh desserts displayed on the cart. She decided that the glass casing on top wasn’t quite clean enough and knew she could not spray glass cleaner while there was food on it. She decided the remove the glass covering and push the cart out that way.

A10-year-old girl suffered from a rare malignancy in her brain and around her spinal cord. she had surgery, and most of the tumor mass was removed, but residual tumor remained in the brain and around the spinal cord. the girl's doctors informed her parents that chemotherapy and radiation were possible treatment options but could cause serious problems such as sepsis, a permanent loss of iq and stature, and even death. the parents wished to proceed with the therapy. while their child was undergoing aggressive chemotherapy and radiation, the parents did independent research and read of several drugs being administered for cancer in other states that were unapproved by the federal drug administration (fda) and were illegal in their home state but were touted by physicians using them as miracle cures." furthermore, one of the girl's doctors released the girl's medical records to another physician to get a "second opinion" without informing the parents. this particular physician is a member of the same country club as the parents. he happens to share facts from the medical records with other members who end up telling the girl's parents. the couple sued their child's physician for failure to disclose alternative treatments, thus depriving them of informed consent. the couples also sued the child's physician for sharing their daughter's records in violation of the girl's privacy. how should the court rule in both cases? did the child's physician involved follow the law? did he act ethically in either situation? explain your answer. under the doctrine of informed consent, should a physician be responsible for informing patients of all treatment options, even if some of the treatments are illegal or not yet proven effective?
