What is the definition of emotional disturbance?

According to the federal law the official definition of emotional disturbance is the situation in which the performance of a child in education has been greatly impacted by the following: (1) they are not able to learn and there is no explanation to why they are not able to learn (2) They have issue making relationship with others or relating in normal way with people around them , (3)They behave inappropriately and display their feeling inaccurately (4) unhappiness/depression, or (5) they also display psychological imbalance

However federal law state that children who only have issues with following rules or who break rules those are said to be socially maladjusted and they can not be included under emotional disturbance category.

The difference between the two is that socially maladjusted children decide not to abide by the given behaviour standards whilst emotionally disturbed children do not possess the mental state to follow the given behavioural standards even if they want to.

Some do argue though against this saying that even socially maladjusted kids do have some signs that are counted under emotional disturbance so it could probably be more effective theorically than practically.
