A Resolução nº 125 do Conselho Nacional de Justiça, que está em vigor desde 29 de novembro de 2010, dispõe sobre a Política Judiciária Nacional de tratamento adequado dos conflitos de interesses no âmbito do Poder Judiciário. Além de instituir a política pública de tratamento adequado de conflitos de interesses, a Resolução 125 tem por objetivo organizar e uniformizar, em âmbito nacional, os métodos consensuais de solução de conflitos que sejam capazes de impactar de forma quantitativa e qualitativa a prestação jurisdicional. Faz alusão expressa à mediação e à conciliação como instrumentos hábeis na redução da litigiosidade, seja evitando o ingresso de novos processos através da prévia solução de conflitos e interesses, seja oportunizando a diminuição de recursos, cujo elevado número deve-se, em tese, à insatisfação das partes com as decisões judiciais.
