In the court stated, "the american tradition of trial by jury, considered in connection with either criminal or civil proceedings, necessarily contemplates an impartial jury drawn from a cross section of the community."

The 14th Amendment

In the writing of the 14th Amendment Justice Murphy insisted that race and religion are completely irrelevant to ones ability to be a fair and effective juror. So he added this clause to make equality in jury selection a Constitutional issue.
